As Binaks Solutions, we process your personal data in accordance with Law No. 6698 on the Protection of Personal Data (“KVKK”) and related legislation and within the scope of our “data controller” role, as explained below. Our company reserves the right to update this “Privacy Notice for Processing of Personal Data” in accordance with changes that may be made in the current official regulations.

Binaks Solutions Privacy Notice for Processing of Personal Data (“Privacy Notice“) has been prepared to inform you transparently about the identity of the data controller, the method and legal basis of collecting your personal data, the purposes of processing these data, to whom and for what purpose they can be transferred, the duration of data processing, and your rights specified in Article 11 of the KVKK. The explanations made for “Your Personal Data” in the Privacy Notice also cover your “Special Category Personal Data.”

Method and Legal Basis of Collecting Your Personal Data:
Your personal data may be collected through automatic or non-automatic methods, depending on your relationship with our Company. These data can be collected verbally, in writing, or electronically through our Company’s affiliated units, human resources department, information technology unit, call center, and similar means. Your personal data may be created and updated as long as your relationship with our Company continues, and it may be processed and kept both digitally and physically. Your personal data may be processed and transferred within the framework of the purposes stated in the second article below and the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

Purposes of Processing Your Personal Data: The collected personal data;
To enable real and/or legal third-party institutions and organizations (visitors, customers, suppliers, business partners, etc.) related to our Company, especially the Tourism and Revenue Administration Presidency, to carry out the necessary work to benefit from the products and services of our Company and/or the Center and units affiliated with our Company, the recording of these processes into the system, the establishment of necessary contracts with these individuals and institutions, if necessary,
Ensuring life and property security, as well as legal, commercial, and occupational health and safety,
Compliance with legal and regulatory requirements arising from laws and secondary regulations such as Law No. 4857 Labor Law, Law No. 6102 Turkish Commercial Code, Law No. 6098 Turkish Code of Obligations, Law No. 6502 Consumer Protection Law, Law No. 3308 Vocational Education Law, Law No. 6331 Occupational Health and Safety Law, Law No. 6698 on the Protection of Personal Data, Law No. 213 Tax Procedure Law, Law No. 5510 Social Security and General Health Insurance Law, and taking necessary measures within this scope,
Conducting inspections and/or regulatory tasks by authorized and competent public institutions and organizations and professional organizations with public institution status,
Fulfillment of information and document requests from judicial authorities and/or administrative authorities,
Keeping records of complaints, objections, requests, suggestions, satisfactions, etc., in our notification management system to provide better service to you,
Recording camera footage at our Company’s locations for security purposes and/or due to legal obligations,
Conducting listing, reporting, and verification analysis of the usage of products and services offered at all centers and units of our Company and making statistical and scientific information in this regard, developing our products and services accordingly, increasing satisfaction related to our products and services, and making customizations for the user within this context,
Directly contacting you through communication channels shared with our Company,
Execution of all Human Resources processes and policies of our Company,
Preservation of public order and health,
Planning and managing the financing of all services offered, invoicing,
Fulfillment of participation requests for education, seminars, etc.,
Taking all necessary technical and administrative measures for data security, systems, and applications,
within the framework of the purposes specified in paragraph 2 of the “Purposes of Processing Your Personal Data” with respect to the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

Your personal data will not be used for purposes other than those stated above without your explicit consent, and it will not be shared or transferred to third parties except for legal obligations and official institutions/organizations.

Sharing and Transfer of Processed Personal Data
The personal data processed by our Company can be transferred to our Company’s affiliated centers and/or units, legally authorized real and/or legal third-party individuals, institutions, organizations, business partners, subcontractors, suppliers, and real and/or legal third-party individuals, and institutions abroad and/or in Turkey within the scope of the purposes specified in the second article of this “Privacy Notice” and in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.

Data Processing Period:
Your personal data will be processed within the scope of the purposes stated in this Privacy Notice, limited to the time periods of data processing and limitation periods specified in the laws and other legal regulations that our Company and the affiliated centers and units are subject to. In addition, your personal data may be processed or shared with third parties in accordance with the information contained in this privacy notice. Your data can be stored for up to 10 years, taking into consideration the maximum periods specified by the laws. If there are any changes to the data processing periods in the laws, the newly determined periods will be taken into account.

Processing of Special Category Personal Data:
In accordance with the KVKK, individuals’ race, ethnic origin, political opinion, philosophical belief, religion, sect, or other beliefs, appearance and dress, membership in associations, foundations, or trade unions, health, sexual life, criminal conviction, security measures, biometric, and genetic data are considered special category personal data. Our Company takes adequate measures as determined by the Personal Data Protection Board for the processing of special category personal data. Our Company will process individuals’ special category data only with their explicit consent and only to serve the purpose of collection.

Rights of the Data Subject under Article 11 of the KVKK:
Subject to the exceptions set forth in Article 28 titled “Exceptions” of the KVKK, within the framework of Article 11 of the Law, you have the right to apply to our Company and request that your personal data be

If processed, to request information about it,
To know the purpose of processing and whether it is used in accordance with its purpose,
To know the third parties in the country or abroad to whom it is transferred,
Request correction if it is incomplete or incorrectly processed,
In accordance with the conditions stipulated in Article 7 of the Law, to request the deletion or destruction of personal data and request notification of these processes to third parties to whom personal data is transferred, if the reasons necessitating their processing cease to exist,

If you suffer damages due to the unlawful processing of your personal data, request compensation of the damages, and rights, as specified in subparagraphs (a) through (i) of Article 11 of the KVKK.
